Influence of logic in law

Abstract

Consistency between logic and law has always been a
reason for scientific argument, therefore, based on
these various aspects of thought, this article aims to
analyse the influence of logic on the application of the
legal sciences, specifying the scope of it and
specifying the intervention of logic as science within
the judicial decisions and arguments of the legal


professionals. This analysis is bibliographic-
descriptive from the historical context. For this


purpose, the review, interpretation and comparison of
definitions, publications and positions of various
authors was carried out for the formulation of new
concepts and the postulation of improved arguments.
It is concluded that logic and law have always been
complementary, since it is logical principles that have
allowed the creation of rational and consistent
arguments for lawyers and, in turn, have given the
necessary skills to magistrates to correctly interpret
what the laws say and their consistent application;
however, the weakness of this process appears when
those involved set aside objectivity and spread their
attention to the search for their own interests.
